There really isn't such a thing as a fake tamagotchi EXCEPT sometimes when the package acctually says "Tamagotchi" then it's fake, but if it says Tamogotchi, Tomogotchi, or Tomagotchi, it's not really a fake, and you can't sue them either.

The reason when you type in "Tamagotchi" in the search engine on ebay and find hundreds of copies is because of the retarded ebay sellers. They make that as one of the tags to try and get you to buy something that looks like a tamagotchi.

You can't sue them because they are making virtual pets, NOT tamagotchis. They are doing what they call 'BUSINESSING" (or however you spell that), and when you do that you compete with other companies. Here are a few examples:

1. Sometimes when I go to Wal-Mart, I sometimes buy waffles. When I go buy the tastey and good Eggo Waffles, I also see another brand. It's called "Great Value". Of course I have tasted both and to me, Great Value Waffles are so disgusting, they taste like cardboard. The Eggo waffles are delicious. Much like the tamagotchi copies are not as fun as the real Tamagotchis. Therefore, Eggo cannot sue Great Value because no matter how similar they can be, it has a diffrent name and certainly, a diffrent taste.

2. Myspace is a pretty popular site for people to have and meet new people and chat with friends. But I also heard of this website called MyYearBook, which is almost just lik Myspace, only a bit diffrent. Now Myspace COULD NOT sue MyYearBook for making that website. Why? Because 1, it doesn't look a lot like Myspace, 2, it is a lot like myspace (the layout isn't) but they called it MyYearBook, therefore they cannot sue them.

3. Now I am sure some people who play neopets think that marapets is a crappy copy of it, right? That is a bit true. The Neopets website first launched back in November of 1999. I am no sure when Marapets launched but it launched a few years after neopets. Now if you have been playing neopets for over a year, you would have seem the old layout, looks a lot like Marapet's layout, right? And Marapets is a lot like Neopets right? Thats right. But Neopets cannot sue Marapets for making a website that is very similar, but with just a few tiny changes, such as the name and some of the gameplay.

Get what I'm saying? Bandai CANNOT sue JD, Honey Lovers, or any of those 'companis' that make Tamagotchi Look-Alikes. Sure they look a lot alike but they have some tiny changes, such as animations, the fact that they can't die, and more.

Basically, what I am saying is...

BANDAI CANNOT SUE ANYBODY FOR MAKING VIRTUAL PETS THAT ARE SO SIMILAR TO TAMAGOCHIS BUT WITH A DIFFRENT NAME AND THAT ARE NOT AS GOOD.

I'm sorry, Courtnee?

But,

1. What does this have to do with a warning? A tama warning is more like

"Dun flush it down the loo"

"Ok thanks! WHy?"

"Cause it breaks."

"Oh."

See what I mean? Moving on,...

2. I se what you mean, but still! I do belive the goes in whats on you rmind, or Non tamatalk.

3. They can't sue them, true, but they could get in seroius trouble for copying something fro that website, more so because at the bottom of teh page it says something like this-

© neopets.com 2007 all rights reserved.

So one simple copy and they could pay. They may ot be able to sue, but they will have to remove it if anyone from TNT (The neopets team) sees it they are in some thick mud.

Thank you.
