ya Bandai could if they wanted because they stole bandais pictures that is copywriting and against the law.

And technically, no you couldn't sue them, because first of all, they don't use the word "Tamagotchi" anywhere. They always use 'Tamogotchi' or just 'Tama' in their packaging. Plus, they don't pretend to be BanDai or have the BanDai logo or anything...

So unless you show us your sources, we won't be able to determind anything ^_^
