Yep. It's fake. Just the fact that the character is weird and not even close to a normal Tama, and the scroller icons.

They're calling ita Tamagotchi when it's clearly not... couldn't they get in trouble with Copyright laws?

It's not called, "tamagotchi color plus", it's called, "Tamagotchi Plus Color".
